Returned goods The Company will only accept the return of the Goods if they are faulty, have been damaged in transit between the Company and Purchaser or if the wrong goods have been delivered. In no other circumstances will goods be accepted as returned. The cost of carriage for returns is at the expense of the Purchaser. Force Majeure The Company shall bear no liability for any loss or damage suffered by the Purchaser if the Company is prevented from fulfilling a Purchaser’s order as a result of industrial dispute or any cause beyond its reasonable control or any liability of the Company to procure materials required for the performance of the order. The Company shall suspend or make partial deliveries or extend the time or times for delivery. (b) Notwithstanding delivery and the passing of risk, property in and title to the Goods shall remain with the Company until the Company has received payment of the full price of all Goods which are the subject of the contract and all other goods supplied by the Company to the Purchaser under any contract whatsoever. Legal construction All contracts to which these Conditions of Sale apply shall in all respects be construed and operate as an English contract and in conformity with English law. Passing of property and risk (a) The risk in the goods shall pass to the Purchaser immediately on delivery of the goods to the Purchaser.
